A St. Cloud man is dead after he was struck by a taxi in downtown St. Cloud on December 2nd.

The man, Timothy Arthur Martin, 33, was crossing between the Le St-Germain Suite Hotel and the Press Bar on Fifth Avenue South just before 2 a.m. when he was hit. The husband and father of two fell and hit his head on the road. He later died at St. Cloud Hospital on Sunday afternoon.

The taxi cab driver, Dylan Joseph Gnoinsky, 22, also of St. Cloud, was not immediately charged with any crime. There was no indication that Gnoinsky was speeding at the time of the accident. It was also found that Martin was crossing the street outside of the crosswalk when he was struck. Minnesota law does state that pedestrians not using a crosswalk or not crossing the street at an intersection must yield to vehicles.

A fellow cab driver to Gnoinsky, John Bruce, said that he knows that Gnoinsky is very shaken by the accident and will need help and time to help from the incident. Pedestrian accidents of this type are not common in downtown St. Cloud. In fact, it is believed that the last reported pedestrian-vehicle accident occurred in 2000.

Bruce states that the accident should be one that reminds pedestrians to use crosswalks whenever possible and to know traffic safety laws, as not being aware of safety laws is a common reason behind such accidents. He further stated that there is a lot of pedestrian traffic downtown in St. Cloud at 2 a.m.

As for Martin, he graduated from St. Cloud Technical High School in 1998. He is survived by his wife, his two children (8 and 4), and his parents John Martin of Nelson, Wisconsin and Mary and Tom Cress of Avon. He is also survived by his siblings and a number of other relatives.
